Custodial justice and Human Rights to Women.

women have a unique position in every society. this is due to the various roles played by them in their life time in spite of her contributions in the life of every indivisual human being. she still belongs to a class or group of society which is in a disadvantaged position on account of several social barriers and impediments. she has been the victim of untold miseries, hardships and atrocities caused ans perpetuated by the male dominated society. in india almost half of the indian population are women. the indian constitution prohibits ny discrimination solely based on gender and given statute of fundamentl rights. various laws have been enacted to deal with the personal matter like marriage , divorce and sucession etc of women. unfortunately only a few such laws could be codified and made uniform. the criminal law also contains numerous provisions to deal with the crimes committed against women. there is evidence of of a pattern of the gross Human R ight violations through out india and abroad. there is overwhelming evidence that wide spread torture often leads directly to death in custody. such evidences has emerged from goverenment officials and official institutions , courts, doctors,who have carried out post mortem examinations on prisoners who have died in custody. in january 1985 th4e then chief justice of supreme court of india noted that only rarely was eye wittness testimony of torture leading to death available other than from police officers who tend to be more concerned to conceal than to acknowledgre what has accured. shortly the law commission of india proposed that the evidence act should be amended by creating a new section 114(B) to provide a rebultable presumption that injuries sustained by a person in police custody has been caused by the police officer in charge of his custody " death in custody are not in the rise" said the attorney general of india when the united nations of Humanright committe asked about it in march 1991.the ultimate form of torture is that which results in the victims death. there is evidence of a pattern of this form of gross Human right violation through out india. the majority of those who died in police custody are people tortured in order to extract a confession or further information about a crime. women from dalit and tribal communities are also liable to be subjected to brutal custodial violence.
On receipt of a report from the collector kamaraja district tamilnadu the custodial rape of t. uma by the head constable of Alangulam police station. the national Human rights commission called for a report. the govt of tamilnadu placed the accused under suspension and asnctioned rupees one lakh to t. uma the victim.
sakhi a delhi based ngo draw the attention of the madhya pradesh govt for rape of jain sadvis which was subject to widespread media coverage. one complain was lodged also and they draw the attention of Human rights commision too.
moti barua a 25 yrs old tribal woman died in police custody at the marjhari police station singhbhum district of bihar on 13 december 1988. the two police officers involved were suspended on the ground that they behaved suspiciously and negligently.
the laws guarding against excess but substanial. the indian constitution protects the rights to life and personal liberty ( article 21) and other fundamental rights. although the prohibition of torture in specific terms lacks constitutional authority. rape of a woman in custody carries an enhanced punishment of 10 yrs of inprisonment under section 376 of indian penal code. which also extends the same punishment to public servants and such as me3mber of armed forces. in cases of death in custody, an inquiry by a magistrate is mandatory under section 176 of the code of criminal procedure. the rights to enforce the human rights provided in the constitution is itself constitutionally protected. article 226 empowers the high courts to issue writs for the enforcement of such rights including habious corpus. article 32 of the constitution grants the same power to the supreme court. although a direct approach to the supreme court is guranted the court has often in practice required victims to approach a high court first. a victim can also bring a civil suit for damages under the civil procedure code and to initiate a criminal prosecution. the laws are enforced by a judiciary with a strong tradition of independence. judges especially of the hugher courtd have time to time given for reaching and innovative decisions. supreme court specially instructed in the case of women accused at the time of arrest to inform nearest legal aid committee immidiately after the arrest so that the committee might provide assistance . the police are also to inform relatives immidiately of an arrest womandetainee and a female officer is to be present during the interrogation of woman detainee. the supreme court also directs city and sessions judges check on the treatment of inmates. the national human rights commission formed a policyfor judicial custody to women. article 1 respects genders dignity and habitative concern for womwn must inform all relevant institutions and personell in the criminal justice and correctional system. women shall be shown special treatments . in article 2 the astate shall endeavour as for the possible to set up specialized service and institutions and exclusive jurisdictions for meeting the needs of women. separate prisons and lockups , correctional centers and separate courts interalia shall be setup to exclusive deal with woman. article 4 all substantive and procedure lawa pertaining to custodialization of womwn shall meticulously respect the womwns needs. the state shall respect the rightds and previleges of the children accompanying the womwn in custody. article 9 states taking account of the special role of women in family life the social devlopment and the vulnerability of girls , the state shall endeavour to avoid the arrest and detaintion of females to the contextpossible and without threatening the states in any manner. some in the the rarest of rare cases to be specified, women shall not be arreste4d between the sunset ans to sunrise. like wise the arrest of women by the men of the police force acting alone shall be avoided. article 10 says arreat and serch of womwn including interrogations shall be conduct4ed according to strict standards of decency and in a manner not to violate the modesty and dignity of womanhood.at no stage during and after arrest, will a woamn arrestee be left unguarded by police women or prescribed authorities. article 12 states to usher in humanism where ever woemn are detained in penal or other custody in addition to basic ammenities and privacy, the state shall provide the essential for meeting womens special needs including those promotive of her dignity.
In raising the questions of human rights protection in india the government should ensure that exisating legal safegurds are respected in all circumstances. the legal mechinary to combat torture should be strengthened. the prohibition of torture aqns other cruelity in human or degrading treatment or punishment should be in corporated inthe constitition. the government should draw updetaild guidelines for the interrogation of suspects and publish then after consulting with lawyers , bar associations, civil liberties groups ans medical proffessional groups. it should review these guidelines periodically in consultation with these groups to ensure that they are remain in effectiver mechanism to prevent torture. special rules should should be drawn upto protect particulary vulnerable groups from cusodial violence. female detainee should be kept separate from male detainee and a female3 officer should be always be present during interrogation. the governement should allow independent bodies to regularly inspect all places where detainee are held. the government should order an authoritative investigation into the causes and the pattern of torture in indiaq and the circumstances facilitating its wide spread occurrance. if nessasary special structures and mechanism should be established to receive reports of torture, rape and deaths in custody. there should be independent bodies in various states formed to monitor such complaints ans supervise appropriate follow up,. these bodiesw should be oblised to report periodically to the public and recommend apppropriate action to be taken to eliminate and prevent custodial violence.

Sexual harassment of Women in Workplaces : A Grevious Concern

Discrimination in employment based on sex and sexual harassment violates the most basic principle of international human right law. of all the forms that violence against women can assume sexual harassment is the most ubiquitous and insidious, all the more so because it seems normal behaviour and not an assault on the female entity. it affects women in all settings whether public or private and have psychological, medical, social, political, legal and economic implications. instance of sexual harassment should not be viewed as isolated incidents.

work place is any place where the work relationship between the employer and the employee exists. your work place may be in office , a factory, a building, a private home, a school. and a store. a woman may work also work outdoors on a road crew or in a vehicle, the wash room , cafeteria and locker room that you use are part of your work place. so any other place where your employer does business. there are hardly any laws and policies are in place to protect her from harassment, no matter where she works. a woman may work as a home maker but a woman is still protected under the law. different work envirronments mens different ways of dealing with harassment. one may experience harassment while going place to place. this can also be seen as work place harassment. her employer cant graduate that she wont be harasses on a bus or walking along a street, but your safety on hte job or in the way ans from the job is their concern. some times harassment that occurs outside the work place affects womanswomans work. actions like these can cause problems or harm relationship among employees.

thus work place harassment is when some one harass you while you are doing your job on your way to or from work. a harasser can be any one you come in contact of your work. the person might be a boss, superviser, manager, mwember of your board of directors, co workers, custmers,patient, delivery person, person in your union. harassment can happen anywhere in the work place. in the lunch room, in rest room or washroom areas. in staff rooms on the production line, in an office, you might also be harassed out side of your workplace. it can happen in a party, on a businesstrip or at a meeting at some ones home. harassment is not always workplace harassment, it dependson the situation and your relationshipto the harasser. if your boss is in your home and demands thast you have sex with him, it is still workplace harassment.if the co worker harass you at work its also a work place harassment. thus the employer of the women is responsible for any form of harassment that affects her in work place and her work.despite these wide connofation of the problem, women from every countery and culture continue to face sex discrimination and sexual harassment in work plaqces. the international community has recognizes both discrimination based on sex in the terms and conditions of employment and sexual harassment as violation of fundamental human rights to women. like other forms of violence here also there is demonstration of power and control and can cause physical, emotional, economic and proffessional injuries to those experience it. thi undermines the inherent dignity of a person and violates the right of every human being to physical and mentqal integrity. it violates a womans right to just and favourable working conditions.
this type of harassment of women is discriminatory when a woman has resonable grounds to believe that her ob jectionwould result in adverse employment actionfor when it creats a hostile working envirronment the honourable supreme court in its judgement dated 13.8.97 in vishakha and others vrs state of rajastan and others taking note of the fact tht the present civil and penal laws in india dont places and that enactment of such legislation will take consideration time, to formulate guidelines to prevent sexual harassment in work places. as such it becames an imperative to study and analize the concept of sexual harassment of working women in india and cause and effect of such a violationsof indivisual right which have resulted in marginalizing the women in work places. hence the ethnography explorative study is conducted to explore the possibilities of curbing this menance. the increse number of working women has brought in a lot of sexual ambiguity into work places. sexual harassment has given up in direct proportion to the numbers emerging out of the home into economic and attitude independence. a centuries old life of entrenched priviledgs is under threat and nothing has prepared males for the situation. this mind set converts itself into the demanding behaviour we hsave to putup with, men brought up in orthodox and conventional homes that tend to be sexually repressed are not often not capable to handling proximity with women.

the supreme court of india passes certain guidelines detailing sexual harassment which further passed in parliament and formed a act to curb sexual harassment in work places and directives are sent to state governmrnts and private and public sector to form a committee to prevent sexual harassment of womwn in work places. they are

* physical contact and advances
*demand or requewst for sexual forms
*sexually coloured remarks
*showing pornography
*anyother unwelcome physical or non verbal conduct of a sexual nature.

in bringing the seriousness of this issue to lime light the non government organizations have sucessfullu highlighted the issues and acted in favour of eradicating and preventing this malady. womens tribunal a paralleled NGO event at the conference of human rights in vienna (1993) presents evidence and spakers from around the world of human rights violations especially violence against women. a recent devlopment of gret importance and interest is the emerge NGOs as advocates, arbitrators, activists for the spectrum of issue from human rights to the envirronment from political and accountability o media monitoring and consumer protection. the world summit for social devlopment (copenhagen1995) called attention to the pivotal role of women in devlopment. it also focoused attention on womens social issues and the discriminatary practices tht present their full participation in society.

advancement of right of women to has been the concern of the world community since if second worls war.the international conference of population and devlopment held in cairo in 1994 was a break through.empowering women and improving their status and essntial to realizeing the full potentioal of economic, political and social devlopments. empowering women is an important enf in itself. atrocities against women in india are noit a new concept. the fact that the opionators, acamedicans and all concerned citizens have stated gradually realizing the sexual harassment to women in work place is a serious violation of fundamental rights asa man and and special rights generated to her under the indian constitution.

Mumbai Blast - a Verdict of Cowards

We Indians no longer safe as we say India is a peaceful and secular nation. the frequency of attacks and the damages of property, life and security is a matter of concern. in every attack the terrorists are well versed and well planned ans well trained too for the attack. seldom we are aware of the attack before hand. lets look at the recent blast in mumbai, its the symbolism of attack to the financial and tourism sector of India. always a high degree of security and mental alertness is required. our intelligence system failed to dictate the attacks before hand. from the time of murder of late rajiv gandhi india was always on threat of terrorists from out side India. what we feel the terrorists worked out methodically. young guys trained out side or any remote place of India taken oath to kill or die. in 1993 march mumbai faced series of blasts and the underground plays a pivotal role. in 2001 we have faced attack in our parliament house in new Delhi. it shook the roots of our countries national security systems. in 2006 series of bombs planted on local trains of mumbai kills 183 innocent people. recently in July 2008 number of blasts occurred in ahmedabads public places kills more than 60 people. now the terrorists used the tactics to enter elite hotels and public places its the new urban terrorism in India. they attack markets,malls, public places,cafes, and target elite class people and westerners. it means to attract the global attraction taking hostage og westerners. its purely madness and cruelty to kill innocent people in the name of religion. as an Indian i condemn the attacks and shocked and grieves for the innocent people who died in this attack. its not just targeting Indians its to hit Indian economy and create threat in the mind of westerners. this evidently confirmed that the attacks are from inside and outside the country and well trained and well versed with the weapons. may the deccan mujahideen claims they did the operations but the sources are from religion rationalists from India and the source from out side. the terrorists are young guys. whom they killed they never thought they also have a family whom they le3ft at their homes.one can only wonder at the minds that can deliberately planned then carry out such operations. at the rage and hatred that permeates their faculties. ordinary people are frightened and seeks protection. they do not know when they go out from home for any work or job no one can assure that they will return home safely.

I salute the martyrs for their bravery who lost their lives to save lives og hundreds of people. i wish god give courage to their family members to bear the loss. and i also pray for thew departe3d souls who have given thier lives for no fault of theirs. our country is still in shock.

History is not a record of regular process. there are set backs and advance but generally the last hundred yrs our society has been increasing respect of human rights. sexuality is a very personal feeling of every human being. people of India still unable to accept homosexuality wholeheartedly. the first gay person who came forward and declare his sexuality was late ashok row kavi. now a days most of us recognize that while other people may look different from us, or behave ins a different way they are equally human and equally deserve respect from the society. so society has to make great efforts in terms of public recognition of lesbian,gay,bisexual and transgenders. people since the days when homosexual acts where against law.now a days the idea of a gay and lesbian celebrity, businessman or political leader is completely unsurprising. but difference will always play a part in some peoples thinking. coming out requires a conscious decisions and some times takes place against against a background of family disapproval. the act of equality in our Indian constitution and human rights gives power to outlaw in in discrimination on the ground of sexual orientation. few years ego a study found that40% of adult lesbians and gay man who have been harassed when they were at schools and educational institutions. they clearly abused by people. it means absolute no sense if a form of behaving is laughed off or ignored its a matter of grievous concern. there are many important historical and contemporary lesbians, gay and bisexual figures who have who had made an invaluable contributions to our culture and history. Alan Turing was an instrumental in cracking the enigma case in 2nd world war was helping to secure the allied victory. Virginia wolf wrote many wonderful novels which enriched our our literature.as well as their contributions to our society like sir Elton john .some times heroic figures have helped to secure greater equality for lesbians , gay, bisexual ans transsexual people. not until 1990s did it became a common speak of gay, lesbians, bisexual and transsexuals people with equal respect at that time. that was a time when homosexual life was hard. they r struggling with their sexuality struggling with their economics status and for life also. its for those who have struggling with their small world, so they ventures out its boarders time to time. parents of those people also decline to accept it. now our law became flexible that they can marry and can adopt children also. govt should help them to settle down in life and counsel them for their health hazards. because AIDS is a vulnerable factor for them. i have all my respect for them and i wish them best of luck in their life.
